By engaging Loveland Brand Design LLC ("LBD") for services, you agree to the following terms. Specific engagement terms, scope, deliverables, timeline, and fees are defined in each signed proposal, which supersedes these general terms where they conflict.
LBD provides marketing strategy, brand development, digital ecosystem build-out, and related services as defined in each engagement proposal. All work is fixed-scope and fixed-fee unless otherwise stated in writing. Work outside the defined scope requires a separate agreement before it begins.
Payment schedules are defined in each proposal. Project-based engagements typically require a deposit before work begins, with the balance due upon delivery. Monthly service engagements are billed in advance. Invoices are due within 15 days of issue. Late payments may result in work suspension.
Upon receipt of final payment, clients receive full ownership of deliverables created specifically for their engagement. LBD retains the right to display completed work in its portfolio unless explicitly agreed otherwise. Third-party assets (stock images, licensed fonts, software) remain subject to their respective licenses.
Timely delivery of content, approvals, and feedback is required for LBD to meet agreed timelines. Delays caused by client inaction may affect delivery dates. LBD will communicate timeline impacts as they arise.
LBD's liability in connection with any engagement is limited to the fees paid for the specific engagement in question. LBD does not guarantee specific marketing outcomes. Results depend on market conditions, client execution, and factors outside our control.
These terms are governed by the laws of the Commonwealth of Kentucky. Disputes will be resolved in Pike County, Kentucky unless otherwise agreed in writing.
